These Terms & Conditions (“Terms”, “Terms of Service”, or “Agreement”) govern your access to and use of kivofashion.com (the “Website”) and your purchase of products from Kivo Fashion.

Throughout these Terms, the words “Kivo Fashion,” “we,” “us,” and “our” refer to Kivo Fashion. The words “you,” “your,” “customer,” or “user” refer to the person accessing the Website or purchasing products from us.

By accessing the Website, placing an order, or otherwise using our services, you acknowledge that you have read and understood these Terms and agree to be bound by them, together with our applicable Privacy Policy, Shipping & Delivery Policy, Exchange & Return Policy, and other policies displayed on the Website.

If you do not agree with these Terms, please do not use the Website or place an order.

1. Eligibility & Acceptable Use

By using this Website or placing an order, you represent that:

• You are legally capable of entering into a binding transaction under applicable law.

• The information you provide to Kivo Fashion is accurate and complete.

• You will use the Website and our products only for lawful purposes.

• You will not use the Website to violate any applicable law, regulation, intellectual property right, or third-party right.

• You will not attempt to interfere with the Website's operation, security, or functionality.

You must not use the Website to transmit malware, viruses, destructive code, fraudulent information, or material intended to disrupt or compromise the Website or our systems.

2. Our Online Store

Kivo Fashion operates an online merchandise store. Our Website and e-commerce infrastructure may be provided or supported by third-party technology providers, including Shopify.

Third-party technology providers may process information or provide infrastructure necessary to operate the Website, subject to their applicable terms and policies.

Kivo Fashion may add, modify, suspend, or discontinue products, features, collections, or portions of the Website from time to time.

3. Products & Product Information

We make reasonable efforts to display product images, colours, designs, descriptions, measurements, and other information as accurately as reasonably possible.

However:

• Actual colours may vary depending on your device, screen settings, lighting, photography, and other factors.

• Minor variations in printing, placement, colour tone, texture, or appearance may occur as part of the manufacturing/printing process.

• Product measurements may have reasonable manufacturing tolerances.

• Product availability may change without notice.

• Certain products may have limited availability.

• Product specifications, designs, packaging, and other characteristics may occasionally change where reasonably necessary.

Such minor variations do not automatically constitute a product defect.

However, nothing in this section limits any remedy available where a product is materially different from its description, specifications, or the order placed.

4. Pricing & Product Availability

Prices displayed on the Website are those applicable at the time of purchase unless otherwise stated.

Kivo Fashion reserves the right to change product prices, offers, promotions, discounts, and availability from time to time.

A price change after an order has been successfully accepted and paid for will not ordinarily alter the agreed purchase price of that confirmed order, except where an order must be cancelled because of an obvious pricing, technical, fraud, or other genuine error.

If an order is cancelled because of such an error, any amount already paid for the cancelled order will be refunded through the applicable payment/refund process.

5. Orders & Order Acceptance

Submitting an order constitutes a request to purchase the selected products.

An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance where verification is still required.

Kivo Fashion may, where reasonably necessary, decline, limit, or cancel an order for legitimate reasons, including:

• Product unavailability

• Suspected fraud or unauthorized payment

• Material pricing or technical errors

• Incorrect or incomplete customer information

• Duplicate or suspicious orders

• Orders appearing to be intended for unauthorized resale or distribution

• Abuse of promotional offers

• Violation of these Terms

• Operational or legal restrictions

If Kivo Fashion cancels an order after payment has been successfully received, the applicable amount paid for the cancelled order will be refunded, subject to the circumstances and applicable law.

Where only part of an order is affected, Kivo Fashion may contact the customer regarding the available options.

6. Payment Terms — No Cash on Delivery

Kivo Fashion currently operates on a 100% prepaid model.

• Cash on Delivery (COD) is not available.

• Orders must be paid in full at checkout through the payment methods made available on the Website.

• Orders are normally processed after successful payment confirmation.

• Kivo Fashion may cancel or hold an order where a payment is flagged by the payment provider as fraudulent, unauthorized, reversed, failed, or otherwise irregular.

Any refund arising from a cancelled prepaid order will be processed according to the applicable refund process.

7. Print-on-Demand Production

Many Kivo Fashion products are produced through a print-on-demand or made-to-order process.

Because production may begin shortly after an order is placed:

• Order modifications are not guaranteed.

• Address changes are not guaranteed.

• Cancellation requests may not be possible once production has begun.

• Once an order has been dispatched, modifications or cancellation may generally no longer be possible.

A request to cancel, modify, or change an order becomes effective only after Kivo Fashion confirms the request.

Simply sending an email or support request does not automatically cancel or modify an order.

8. Customer Responsibility for Order Information

Customers are responsible for providing accurate and complete:

• Name

• Shipping address

• Pincode

• Mobile number

• Email address

• Other information required to process or deliver the order

Kivo Fashion is not responsible for delivery problems caused by inaccurate, incomplete, outdated, or incorrectly entered information supplied by the customer.

Where an order is returned to origin because of customer-provided incorrect information, refusal of delivery, repeated failed delivery attempts, or other customer-caused circumstances, applicable re-shipping or other recoverable logistics costs may be payable by the customer.

9. Shipping & Delivery

Shipping and delivery are governed by our Shipping & Delivery Policy, which forms part of these Terms.

Delivery dates and timeframes displayed on the Website are generally estimates and may be affected by courier operations, public holidays, weather, transportation disruptions, remote-location serviceability, or other circumstances beyond our reasonable control.

Kivo Fashion will make reasonable efforts to process and dispatch orders within the stated processing timeframe.

10. Exchanges, Returns & Refunds

All exchanges, returns, replacements, and refunds are governed by our Exchange & Return Policy.

The applicable policy may distinguish between:

• Customer-selected size or preference issues

• Incorrect products supplied by Kivo Fashion

• Manufacturing defects

• Transit damage

• Customer-caused damage

• Customer-requested discretionary returns

• Delivery/RTO issues

Where an issue is attributable to Kivo Fashion, we will provide the applicable remedy in accordance with our policies.

Where an issue results from customer selection, information, preference, handling, or other customer-caused circumstances, applicable shipping, processing, or other reasonable costs may be borne by the customer as disclosed in the applicable policy.

Nothing in these Terms is intended to exclude any consumer right or remedy that cannot lawfully be excluded.

11. Customer-Caused Costs & Losses

Where additional costs are incurred because of circumstances reasonably attributable to the customer, Kivo Fashion may require the customer to bear applicable costs, subject to applicable law and the relevant policy.

Examples may include:

• Incorrect or incomplete delivery information

• Customer-requested address changes after processing

• Refusal of delivery

• Repeated failed delivery attempts caused by customer unavailability

• Return-to-origin shipments caused by customer actions

• Additional customer-requested exchanges

• Discretionary customer-requested returns

• Damage caused by misuse, washing, alteration, or improper handling

• Failure to comply with reasonable return or pickup requirements

Any such charge will be based on the applicable policy, disclosed amount, or reasonably incurred and recoverable cost, as applicable.

12. Intellectual Property

Unless expressly stated otherwise, the Website and its content, including Kivo Fashion's original branding, logos, website copy, photographs, graphics, artwork, product designs, illustrations, layouts, and other original materials, are owned by or licensed to Kivo Fashion to the extent applicable.

Nothing on the Website grants you ownership of Kivo Fashion's intellectual property.

You must not, without prior written permission:

• Reproduce or commercially exploit Kivo Fashion's original designs

• Copy or redistribute our original graphics

• Sell or manufacture products using our designs

• Systematically scrape or download our Website content

• Copy our branding or create confusingly similar branding

• You have the necessary rights or permission to submit the content.

• The content does not unlawfully infringe another person's rights.

• The content is not fraudulent, defamatory, unlawful, abusive, or misleading.

By submitting content for publication or promotional use, you grant Kivo Fashion a non-exclusive, royalty-free, worldwide permission to use, reproduce, display, adapt, and publish that content for legitimate business, marketing, or promotional purposes, subject to applicable law.

Kivo Fashion may remove or decline to publish content that violates our policies or applicable law.

To the extent permitted by applicable law, you agree to compensate Kivo Fashion for reasonable losses, claims, liabilities, or expenses arising directly from:
